1. Agreement to Terms
By booking a Pop-Up Fairway event, completing payment, or allowing Pop-Up Fairway to set up and operate at your location, you ("the Client") agree to be bound by these Terms of Service and the Liability Waiver contained herein. These terms apply to all events, including private, corporate, and public bookings.
2. Booking & Payment
Deposits & Payment Schedule
All bookings require a 50% non-refundable deposit at the time of booking to secure your date and time. The remaining balance of 50% is due 30 days prior to the event date.
For bookings made within 30 days of the event date, 100% of the total booking amount is due at the time of booking.
Failure to submit the remaining balance by the due date may result in forfeiture of your booking without refund of the deposit.
Cancellation Policy
- Cancellations requested more than 30 days prior to the event date will be honored in full, and any payments beyond the deposit will be refunded.
- Cancellations requested within 30 days of the event date will be honored at 50% of the total booking amount. The remaining 50% will be forfeited.
- The initial 50% deposit is non-refundable under any circumstances.
3. Weather & Rescheduling
Pop-Up Fairway will make every reasonable effort to accommodate events regardless of weather conditions. Our inflatable enclosure is fully enclosed and weather-resistant for light to moderate conditions.
In the event that severe weather, high winds, or unsafe conditions prevent the event from taking place as planned, Pop-Up Fairway will work with the Client to:
- Move the event to an available indoor location, or
- Reschedule the event within a 30-day window from the original event date, subject to availability.
Weather-related rescheduling does not entitle the Client to a refund. Pop-Up Fairway is not responsible for weather conditions beyond our control.
4. Equipment & Damages
Pop-Up Fairway will arrive with fully functional, professionally maintained equipment. The Client accepts full financial responsibility for any damage to Pop-Up Fairway equipment caused by the Client, their guests, or any third parties present at the event.
This includes but is not limited to damage to the inflatable enclosure, projection screen, launch monitor, hitting mats, audio/visual components, and any other equipment brought to the event by Pop-Up Fairway.
In the event of damage, Pop-Up Fairway will assess the cost of repair or replacement and invoice the Client accordingly. The Client agrees to remit payment for damages within 15 business days of receiving the invoice.
Pop-Up Fairway is not responsible for any damage to the Client's property, venue, or surrounding areas caused by normal use of our equipment, provided setup guidelines and space requirements were met.
5. Alcohol Policy
Pop-Up Fairway does not sell, provide, or distribute alcohol at any event. In accordance with Texas Alcoholic Beverage Commission (TABC) regulations, alcohol service is solely the responsibility of the Client and their guests.
Clients and their guests are permitted to provide and consume their own alcohol at private residences and private corporate events where such consumption is lawful and permitted by the venue.
Pop-Up Fairway reserves the right to remove any individual from the simulator enclosure who appears to be intoxicated, is behaving unsafely, or poses a risk to themselves, other guests, or Pop-Up Fairway equipment. Pop-Up Fairway staff will exercise this right at their sole discretion and are not liable for any disruption to the event that results from the removal of an intoxicated participant.
The Client assumes full responsibility for the conduct of their guests, including any conduct related to alcohol consumption.
6. Age Requirements
Public Events: Participants must be at least 7 years of age to use the golf simulator at public events, including festivals, fundraisers, and community gatherings.
Private Events: There is no minimum age requirement for private bookings. However, the Client acknowledges that all participants — regardless of age — are subject to the damage and liability provisions of these Terms. Parents and guardians are responsible for supervising minor participants at all times.
7. Travel Fees
Pop-Up Fairway's primary service area covers the Dallas-Fort Worth Metroplex including, but not limited to, Dallas, Fort Worth, Frisco, Plano, Allen, McKinney, Prosper, Southlake, and Arlington.
Events located outside the standard DFW service area may be subject to a travel fee. Travel fees are assessed on a case-by-case basis and will be disclosed to the Client prior to booking confirmation. The Client agrees to pay any applicable travel fees as part of the total booking amount.
8. Liability Waiver
Please read this section carefully. By booking a Pop-Up Fairway event, you agree to the following waiver on behalf of yourself and all guests attending your event.
Assumption of Risk
Golf simulation involves physical activity, including swinging golf clubs, and carries an inherent risk of injury. The Client acknowledges and accepts that participation in the Pop-Up Fairway experience involves certain risks, including but not limited to physical injury from golf club use, contact with equipment, or tripping and falling within or around the simulator enclosure.
Release of Liability
To the fullest extent permitted by law, the Client, on behalf of themselves and all guests attending the event, agrees to release, waive, discharge, and hold harmless Pop-Up Fairway, its owner, employees, agents, and representatives from any and all claims, demands, damages, losses, or liability arising out of or related to participation in the Pop-Up Fairway experience, including but not limited to personal injury, property damage, or death, whether caused by negligence or otherwise.
Indemnification
The Client agrees to indemnify and defend Pop-Up Fairway against any claims, suits, or proceedings brought by the Client's guests or any third parties arising out of or related to the event.
Guest Acknowledgment
By allowing their guests to participate in the Pop-Up Fairway experience, the Client represents that they have authority to execute this waiver on behalf of their guests and that all guests have been made aware of the inherent risks of participation.
9. Conduct & Right to Refuse Service
Pop-Up Fairway reserves the right to refuse service, halt an event, or remove any individual from the simulator enclosure for conduct that is unsafe, disruptive, or threatening to Pop-Up Fairway staff, guests, or equipment. This includes but is not limited to intoxication, aggressive behavior, misuse of equipment, or failure to follow staff instructions.
In the event that Pop-Up Fairway is required to halt an event due to the conduct of the Client or their guests, no refund will be issued.
10. Force Majeure
Pop-Up Fairway is not liable for failure to perform its obligations under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, government restrictions, or equipment failure caused by third parties.
11. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes arising under these Terms shall be resolved in the courts of Collin County, Texas.
